Heirs and shares are determined according to the wishes expressed by the decedent in the will.<\/li>\n\n\n\n<li><strong>Necessary Succession:<\/strong> Guarantees the legitimates (spouse, children, ascendants if there are no children) a share of the deceased&#8217;s estate, regardless of testamentary provisions. This minimum share is called the \u201clegitimate\u201d share.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Let&#8217;s look at the main features:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legitimate_Succession\"><\/span>Legitimate Succession<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Definition:<\/strong> Legitimate succession occurs in the absence of a valid will. The rules of legal succession are established by law.<\/li>\n\n\n\n<li><strong>Heirs:<\/strong> Legitimate heirs are determined by law and follow an order of priority. Generally, the next of kin have priority, and in particular:\n<ul class=\"wp-block-list\">\n<li>Spouse<\/li>\n\n\n\n<li>Sons<\/li>\n\n\n\n<li>Parents and other ascendants<\/li>\n\n\n\n<li>Brothers and sisters<\/li>\n\n\n\n<li>Other relatives up to the sixth degree<\/li>\n\n\n\n<li>In the absence of heirs, the state<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Distribution of the estate:<\/strong> The deceased&#8217;s estate is distributed according to the shares prescribed by law. For example, if the deceased leaves a spouse and two children, the estate is divided equally between them.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Testamentary_Succession\"><\/span>Testamentary Succession<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Definition:<\/strong> Testamentary succession occurs when the deceased has left a valid will in which he has expressed his wishes on how to distribute his assets.<\/li>\n\n\n\n<li><strong>Heirs:<\/strong> Heirs are those named in the will. The testator may designate anyone as heir, including unrelated persons, charities, friends, etc.<\/li>\n\n\n\n<li><strong>Distribution of the estate:<\/strong> The estate is distributed according to the provisions of the will, as long as the legitimate shares reserved for the legitimates (spouse, children and ascendants) are respected. These necessary heirs are entitled to a portion of the estate that cannot be injured or annulled by contrary testamentary provisions.<\/li>\n\n\n\n<li><strong>Distribution of the estate:<\/strong> Legitimate shares are established by law and vary according to family composition.
